These Terms of Service govern access to and use of the CanPath platform, including account registration, immigration assessments, document processing, chat features, and related outputs.
Fruir
By accessing, creating an account for, or using the CanPath service, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.
Fruir operates the service from 235 Randall St, Oakville ON L6J 1P5, Canada.
If you use the service on behalf of a business, law firm, organization, or other entity, you represent that you have authority to bind that entity to these terms.
CanPath provides software tools, automated assessments, document processing, summaries, scores, recommendations, stream comparisons, and related outputs for general informational and educational purposes only.
The service does not provide legal advice, does not create a solicitor-client, lawyer-client, consultant-client, fiduciary, or other professional advisory relationship, and is not a substitute for individualized advice from a qualified immigration lawyer or other authorized immigration professional.
Canadian immigration laws, streams, intake criteria, quotas, scoring systems, ministerial instructions, forms, and documentary requirements can change at any time. While we attempt to keep the service current, we do not warrant that any stream database, recommendation, ranking, eligibility assessment, timeline, score, or narrative explanation is current, complete, accurate, available, or suitable for your particular circumstances.
You acknowledge that the system may compare a user profile against outdated, paused, capped, expired, incomplete, withdrawn, incorrectly mapped, or otherwise unavailable immigration streams or criteria. No output generated by the service is legally binding on any government authority, visa office, officer, tribunal, or court.
We do not guarantee admission, approval, invitation to apply, nomination, permanent residence, work authorization, study authorization, or any other immigration outcome.
Before filing an application, making a move, resigning from employment, spending money, relying on a result, or taking any material immigration-related step, you should consult a qualified immigration lawyer or other authorized professional who can assess your circumstances and the current law.
You are solely responsible for verifying deadlines, eligibility requirements, official forms, supporting documents, and all information submitted to government or third parties. You are also responsible for the accuracy, legality, and completeness of any information or documents you provide through the service.
You agree to provide accurate registration information, maintain the confidentiality of your credentials, and notify us promptly of suspected unauthorized access to your account.
We may suspend or terminate access where we reasonably believe an account is being used unlawfully, fraudulently, abusively, in breach of these terms, or in a way that creates security, privacy, legal, or reputational risk.
As between you and us, you retain whatever rights you may have in the personal information, documents, text, and other materials you submit, subject to applicable law and the rights granted in these terms.
You grant us and our affiliates, service providers, subprocessors, successors, and assigns a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt, analyze, transmit, display internally, create derivative works from, and otherwise use submitted information and service interaction data to operate, secure, maintain, troubleshoot, improve, train, audit, support, document, and commercialize the service and related business operations, to the extent permitted by applicable law and our Privacy Policy.
You represent and warrant that you have all rights and permissions necessary to submit the information and documents you provide, including where they relate to another person.
Our collection, use, storage, disclosure, and retention of personal information are described in the Privacy Policy. By using the service, you acknowledge that personal information may be processed as described there, including for assessment generation, support, analytics, fraud prevention, model improvement workflows, and compliance.
Where consent is required by law, you agree to provide only information for which you have the required authority and consent.
You may not use the service to violate law, infringe rights, upload malicious code, probe or bypass security controls, scrape the service at scale, reverse engineer restricted portions of the system except where prohibited by law, or submit unlawful, deceptive, harassing, or infringing content.
You may not present the service output as legal advice from a licensed professional unless that output has been independently reviewed and adopted by an authorized professional.
To the maximum extent permitted by law, the service is provided on an "as is," "as available," and "with all faults" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including any implied warranty of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, quiet enjoyment, or results.
We do not warrant that the service will be uninterrupted, error-free, secure, or free from harmful components, or that defects will be corrected within any specific timeframe.
To the fullest extent permitted by law, neither we nor our affiliates, officers, employees, contractors, licensors, service providers, or partners will be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or for any loss of profits, revenue, business opportunity, goodwill, data, savings, or expected immigration outcomes arising out of or related to the service.
To the fullest extent permitted by law, our aggregate liability arising out of or relating to the service shall not exceed the greater of the total amount you paid us for the service in the twelve months preceding the event giving rise to the claim, or one hundred Canadian dollars.
You agree to defend, indemnify, and hold harmless us and our affiliates, officers, employees, contractors, and service providers from and against claims, losses, liabilities, damages, judgments, penalties, costs, and expenses, including reasonable legal fees, arising out of or related to your content, your misuse of the service, your violation of these terms, or your violation of law or third-party rights.
We may modify, suspend, or discontinue all or any part of the service at any time. We may also update these terms from time to time. Continued use of the service after updated terms become effective constitutes acceptance of the revised terms to the extent permitted by law.
Except to the extent prohibited by applicable law, these terms and any dispute, claim, or controversy arising out of or relating to the service shall be governed by the laws of Ontario, Canada, without regard to conflict-of-laws principles.
Except where applicable law requires otherwise, you agree that courts located in Ontario, Canada shall have exclusive jurisdiction over disputes arising from or relating to these terms or the service.
